THE Constitution was passed by the All People’s Congress (APC ), in 1991.
President J. S. Momoh, took certain evasive measures to prevent his own party from scuttling his effort , by creating a constitutional committee outside of parliament. With a one party system, he had the authority to do so. The official dictum of governance, was the PA.Syndrome What was handed over to the legislature, was a fate accompli.
Very little or nothing was done to change the 1991constitution, in parliament. The NPRC, made a very lazy attempt to review the constitution, but these attempts were merely cosmetic.
The present APC, is bent on making changes, albeit because they just can’t leave good alone.
I have told you the above story, to draw your attention to a major encrochment of the executive into the legislature’s power of review.
The powers to review the constitution, were cleverly given to the legislature and the judiciary.
Parliament, makes the laws of the country, the judiciary through jurisprudence, test’s the laws constitutionality. If the new law passes the test, it is deemed constitutional. If it fails, it is unconstitutional. When there’s ambiguity, the court sends it back to parliament for REVIEW, to give the court clearity. I have used capital letters, to highlight the word review, because it is from this point that the legislature, is given the power of review of the constiution. Only the legislature has the power to review our constitution, not the CRC. The action taken by the executive to create the CRC, is UNCONSTITUTIONAL.
MY POLICY, IS TO STRENGTHEN PARLIAMENT WHEN ELECTED.
WE FOUGHT FOR DEMOCRACY AND UNDER MY GOVERNMENT, WE WILL GET DEMOCRACY.
